WILLIAMSPORT – Sixty-five employees of two convenience stores in Pennsylvania that also sell gasoline are to receive a total of $59,690 in back wages as the result of a federal judge finding the owner violated the Fair Labor Standards Act.

U.S. Middle District Matthew W. Brann on Tuesday also found Mohammad Tahir was liable for another $59,690 in liquidated damages and enjoined him from future violations of the act.

The U.S. Department of Labor sued Tahir, accusing his businesses of not paying employees minimum wage or overtime between April 11, 2015, and last Dec. 17.

Tahir’s Lewisburg-based business operates Promised Land Truck Stop in Tafton and Whistle Stop in Greentown, both in Pike County, under Shalimar Distributors and Tafs Corp, respectively.

In granting the Labor Department’s motion for summary judgment, Brann found the defendants:

  • Failed to maintain adequate timesheets and payroll records.
  • Made cash payments to employees that did not appear in records.
  • Did not show in records hours spent counting cash in registers or preparing end-of-shift reports on fuel and lottery sales.
  • Deducted wages to cover cash register shortages.
  • Paid employees straight time when they worked more than 40 hours or classified them as assistant managers to avoid paying overtime.
  • Willfully failed to adhere to the Fair Labor Standards Act.

Although Tahir claimed employees were properly compensated and he denied failing to pay employees to count cash or do end-of-shift reports, Brann pointed out no supporting evidence was submitted.
