A New Jersey based consulting, technology and staffing firm will pay over $345,000 to settle US Justice Department allegations that it underpaid high skilled H-1B workers in violation of federal immigration and employment regulations.

US prosecutors alleged that many of Edison-based Savantis Solutions LLC’s H-1B workers were not paid the required wage in regular intervals at the required wage rate from January 2014 through June 2018.

Formerly known as Vedicsoft Solutions LLC and Vedicsoft Holdings LLC, Savantis also failed to properly pay many of its H-1B workers in conformance with their applications to the federal government and federal regulations, the Justice Department said in a media release.

Prosecutors also contended that Savantis improperly recruited H-1B workers by requesting that they provide security deposits to Savantis prior to Savantis submitting their H-1B Cap lottery applications.

The resolution requires the company to pay $345,365 in restitution, which will be used to pay back wages plus interest to employees and former employees of the company, the release said.

The company is also required to hire an outside law firm to serve as a monitor to ensure ongoing and continued compliance with the relevant rules and regulations for the next three years, it said.

The Justice Department did not mention the nationality of foreign workers, but more than half H-1B workers in the US come from India. Savantis also has a presence in India.

A Department of Labor investigation found that Savantis would bring foreign nationals into the US or hire foreign nationals already in the country on an H-1B visa, to perform work and fulfill contracts with its customers and third-party work sites.

The Trump administration has targeted such employment arrangements using H-1 B high skilled speciality occupation visa program to replace the jobs of US workers.
